These Auction Terms govern your participation in auctions hosted on auction.feralbase.com (the "Platform"). By bidding on or listing items, you agree to these terms.
FeralBase Collective ("we," "us," or "FeralBase") operates this Platform as a venue where sellers can list items and bidders can place bids. The Platform is built and operated by Bahar Labs. We are not a party to the transactions between sellers and bidders. We do not own, sell, or take possession of items listed on the Platform.
Think of us like a community bulletin board: we provide the space, but the people posting and responding are responsible for their own dealings.
Placing Bids
When you place a bid, you are making a binding offer to purchase that item at your bid price. You cannot retract bids once placed. If you win an auction, you are obligated to complete the purchase.
Payment
Winning bidders must pay within 48 hours of auction close unless the listing specifies otherwise. We use third-party payment processors (such as Stripe) to handle transactions. We are not affiliated with these processors and are not responsible for their performance or any payment processing issues.
Item Condition and Accuracy
Sellers, not FeralBase, are responsible for the accuracy of item descriptions, photos, and condition statements. We encourage you to ask sellers questions before bidding. Review item descriptions carefully because all sales are final once you place a winning bid.
Shipping and Delivery
Sellers are responsible for shipping arrangements, costs, and delivery timelines unless the listing states otherwise. We do not handle shipping, packing, or delivery. Any shipping disputes are between you and the seller.
Listing Items
You are solely responsible for your listings, including descriptions, photos, pricing, and any claims about item condition, authenticity, or provenance. Do not list items you do not have the right to sell.
Your listings must be accurate and not misleading. If AI-assisted descriptions are used (see our How We Use AI page), you remain responsible for reviewing and approving all content before publication.
Fulfillment
Once an auction closes, you must honor the winning bid. Ship items within the timeframe stated in your listing (or within 7 business days if not specified). Provide tracking information when available.
Prohibited Items
Do not list items that are illegal to sell, stolen, counterfeit, or hazardous. We reserve the right to remove listings and suspend accounts for violations.
Fees
See our Pricing page for current platform fees. Payment processor fees are separate and charged by the processor, not by us.
If a dispute arises between a bidder and seller, the parties should attempt to resolve it directly. We may, at our discretion, help facilitate communication, but we are not obligated to mediate or resolve disputes.
We are not responsible for items that are not as described, damaged in shipping, never delivered, or otherwise unsatisfactory. These matters are between the bidder and seller.
We provide the Platform. We do not:
We may:
You agree to indemnify and hold harmless FeralBase Collective, its officers, directors, volunteers, and agents from any claims, losses, or damages (including legal fees) arising from your use of the Platform, your listings, your bids, or your violation of these terms.
To the maximum extent permitted by law, FeralBase Collective is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim related to the Platform will not exceed the fees you paid to us in the 12 months before the claim arose.
We may suspend or terminate your account at any time, for any reason, with or without notice. Common reasons include violating these terms, providing false information, or engaging in fraudulent activity.
We may update these terms from time to time. We will post changes on the Platform and update the "Last Updated" date. Your continued use of the Platform after changes take effect constitutes acceptance of the new terms.
These terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes will be resolved in the courts located in Buncombe County, North Carolina.
